TEMPORARY LEASE - TOURISTIC USE

PREMISE:

  • that the Società Fonte del Merlo Srl has the free and full availability of the two entire real estate units called “Podere Fonte del Merlo”, located in the Municipality of Fauglia (PI), Via Scacciapolli 7, registered with cadastral identification: Unit 1) sheet map 25 , parcel 159, subalterns 6 (dwelling) and 7 (warehouse); Unit 2) sheet of map 25, particle 185, subalterns 7 (dwelling) and 8 (warehouse);
  • that the Società Fonte del Merlo Srl intends to rent a part of the same as a temporary lease real estate

All this having been said, with this private writing, to be valid for all purposes of law between the parties, as identified above and domiciled,

THE FOLLOWING IS AGREED AND CONCLUDED:

 

Art 1 Subject

 

Hereby, the Lessor grants to the Lessee, who accepts in the same state of fact and law in which it is located, for tourist use only and with the exclusion of any other, all the internal and external spaces of Podere Fonte del Merlo, of which the Lessor has full availability, as expressed in Introduction to this contract.

 

Art. 2 Prohibitions and obligations

 

The Tenant undertakes to enjoy the property for residential use exclusively for tourist purposes.

The Tenant is prohibited from subletting or granting to third parties, even in a precarious and/or temporary way, the enjoyment of the property, otherwise the termination ipso jure of this contract.

The Tenant is obliged to keep and keep the property with due care, providing for ordinary maintenance, undertaking not to modify or transform the property, returning it at the end of this contract in the state of fact and law in which it was received, subject to normal deterioration of use.

The Tenant undertakes to inform the owner of any defects in the property and furniture by the day of the keys delivery.

The property must be used exclusively for tourist purposes and, together with the Tenant, it will accommodate the requested number of people up to a total of 18 persons. At the same time as the keys are handed over, all the names of the guests and their identification documents must be presented to the Lessor for the registration of the guests at the competent authorities.

 

Art. 3 Duration

 

The present contract is made for temporary use only, for the duration of the booked days, on the website poderefontedelmerlo.it . Upon expiration, it will cease without the need for any cancellation, which is understood as date by then, with obligation of the Tenant to return the property to the Lessor. The keys to the property must be returned by 10am at the moment of check-out.

 

Art. 4 Fees and expenses

 

For the instalment of the payment, agreed in advance between the parties, the total amount of the rent can be paid in three equal instalments: the first at the time of signing the contract, also valid as a deposit; the second one within 60 days before the arrival of the guests; the final balance of the last instalment must be paid no later than 30 days before the arrival of the guests.

The deposit and subsequent instalments must be paid by cash or by bank transfer to the bank details in the name of the Lessor, as follows

Art. 5 Liability

The Tenant is responsible for any damage caused by its guests to the spaces leased, previously indicated in point 1, and expressly exempts the Lessor from all liability not arising from the ownership of the spaces it leases. The Tenant, by signing this contract, assumes full responsibility for any accidents and damages caused to property and/ or persons, relieving the Lessor party from any civil or criminal liability.

 

Art. 6 Withdrawal

In the event that the conducting party intends to withdraw from this contract, the same undertakes to express its will by e-mail at least 30 days before the date fixed for the lease. In the event of withdrawal from this contract, the amount paid as a down payment, that is the amount of the first instalment paid, will be retained by the Lessor as compensation. In the event of failure to comply with the above deadline, the first and second instalments, or two thirds of the total amount of the rent, will be retained for cancellation made no later than 14 days before the date fixed for the rental. For the withdrawal in the last two weeks prior to the date of arrival of the guests, no compensation is expected for the Tenant.

 

Art. 7 Privacy policy

Pursuant to art. 13 of D.Lgs. n.196/2003 relating to the processing of personal data, the Conductor gives consent to the processing of personal data only and exclusively for the purposes of carrying out the activities in question.
